Terms of Service
These Terms of Service govern your access to and use of SoldFetch's eBay data APIs, dashboard, playground, documentation, and related services.

These Terms of Service ("Terms") form an agreement between you ("you" or "your") and SoldFetch ("SoldFetch," "we," "us," or "our"). They govern your access to and use of our websites, accounts, dashboard, REST API, REST API, MCP tools, playground, documentation, support, and related features (collectively, the "Service").
By creating an account, accepting these Terms during authentication, accessing the Service, or using an API key, you agree to be bound by these Terms and the policies incorporated into them. If you use the Service for an organization, you represent that you have authority to bind that organization. If you do not agree, do not use the Service.
The Service is intended primarily for business and professional use. If you use it as a consumer, mandatory consumer protections applicable to you are not excluded or limited by these Terms.

1. Definitions
- "API" means a SoldFetch programming interface, including REST, REST, and MCP interfaces made available under your plan.
- "API Key" means a credential issued by SoldFetch that authenticates API requests and associates usage with an account or organization.
- "Documentation" means the guides, schemas, API reference, examples, and technical materials we make available for the Service.
- "Marketplace Data" means publicly observable eBay marketplace information retrieved through the Service, including product, offer, seller, review, category, and search-result information.
- "Operation" means a customer-initiated REST operation, REST query, or MCP tool invocation processed by the Service.
- "Output" means Marketplace Data, normalized records, estimates, exports, and other results returned by the Service.
- "Plan" means the free, usage-based, subscription, or enterprise service level associated with an organization.
- "Unit" means the usage quantity used to meter a successful Operation.
- "Upstream Provider" means a third-party service SoldFetch uses to acquire Marketplace Data on your behalf.
2. Eligibility and Account Registration
2.1 Eligibility
You must be at least 18 years old and legally capable of entering into a binding agreement. If you use the Service for an organization, you represent that you are authorized to act for it and that the organization accepts these Terms.
2.2 Account Information
You must provide accurate, current, and complete account and billing information and keep it updated. You may not create an account using a false identity, impersonate another person, or create accounts to evade a restriction, suspension, quota, or charge.
2.3 Account Security
You are responsible for safeguarding your authentication credentials, recovery methods, organization membership, and API Keys. Use reasonable access controls, remove users who no longer require access, and notify us promptly at contact@soldfetch.com if you suspect unauthorized access. You are responsible for activity resulting from your failure to protect credentials, except to the extent caused by SoldFetch's breach of these Terms or applicable law.
3. Description of the Service
SoldFetch provides a normalized interface for requesting publicly observable eBay marketplace information. Depending on your Plan, the Service may include:
- REST API — documented endpoints for eBay product, offer, seller, review, search, category, and related marketplace operations;
- REST API — a structured query interface for supported Operations;
- MCP tools — a Model Context Protocol interface for supported agent workflows;
- Playground and public tools — browser-based experiences for testing selected Operations;
- Dashboard — account, organization, API Key, usage, export, team, and billing controls; and
- Documentation and support — technical reference material, examples, and support appropriate to your Plan.
The current operation catalog, schemas, limits, and supported interfaces are published in the Documentation and dashboard. We may add, modify, or retire features as described in these Terms.
4. API Access and Keys
4.1 Issuing API Keys
Authorized organization members may create API Keys subject to the limits and permissions of the applicable Plan. A complete API Key is displayed once. Store it securely because it cannot be recovered later.
4.2 Key Security
Do not publish an API Key, commit it to a public repository, embed it in client-side code, or disclose it to anyone who is not authorized to act for your organization. If a key may have been exposed, revoke it promptly and issue a replacement.
4.3 Responsibility for Usage
Operations authenticated with your API Keys are attributed to your organization for metering and billing. You are responsible for authorized users and applications and for usage resulting from inadequate credential safeguards. Notify us promptly of suspected compromise so we can help limit further use.
5. Units, Plans, Billing, and Payments
5.1 Unit Metering
One successful customer Operation consumes one Unit, regardless of whether it uses REST, REST, or MCP. Authenticated cache hits count as successful Operations. Validation, authentication, rate-limit, quota, upstream-provider, and timeout failures consume zero Units. Internal provider retries and implementation fan-out do not add customer Units.
5.2 Current Plans
The Plan catalog used by the Service currently includes:

The Pricing page, dashboard, checkout, or an applicable order form identifies the Plan available to you, its billing period, included Units, rate and concurrency limits, retention period, capabilities, and current price. The information shown at checkout or in a signed order form controls if it differs from this summary.
5.3 Recurring Charges and Usage Charges
Paid Plans are recurring subscriptions processed by Stripe. By starting a paid Plan, you authorize SoldFetch and Stripe to charge the applicable base price, metered usage, taxes, and other amounts disclosed before checkout to your selected payment method. Usage charges may be calculated and invoiced after the billing period in which the Operations occurred.
You must keep payment information current. If a payment fails, we may retry it, restrict paid features, move the organization to an available free Plan, or suspend access after reasonable notice where practical.
5.4 Plan Changes and Cancellation
Upgrades may take effect immediately. Downgrades and cancellations generally take effect at the end of the current billing period unless the dashboard, checkout, or order form says otherwise. You can manage an eligible paid subscription through the Stripe billing portal linked from the dashboard.
Cancellation stops future renewal but does not reverse charges already incurred. You remain responsible for metered usage and other amounts accrued before cancellation takes effect.
5.5 Refunds, Billing Errors, and Taxes
Except where required by law or expressly stated in an order form, payments for a billing period already begun and usage already incurred are non-refundable. If you believe a charge is incorrect, contact contact@soldfetch.com promptly with enough information for us to investigate.
Prices may exclude applicable taxes. You are responsible for taxes, duties, and governmental charges associated with your purchase, other than taxes imposed on SoldFetch's net income. Nothing in this section limits a mandatory cancellation, refund, or statutory remedy available to a consumer.
6. Free Service
The Hobby Plan and anonymous public tools may be provided without charge and may have separate request, browser, IP, quota, interface, and retention limits. No payment method is required for the Hobby Plan. Free access is for evaluation and low-volume use and is subject to the same acceptable-use and security requirements as paid access.
We may change or discontinue free features prospectively. Where reasonably practical, we will provide notice of a material reduction that affects an active account. Free Units have no cash value, cannot be transferred, and cannot be exchanged for money.
7. Acceptable Use
This Section 7 is SoldFetch's acceptable-use policy and forms part of these Terms. You may use the Service only for lawful, authorized purposes and only when you have the rights and permissions needed for your workflow and use of Output.
Among other restrictions, you must not:
- access accounts, systems, or non-public data without authorization;
- evade rate limits, quotas, billing controls, authentication, or technical safeguards;
- use the Service for unlawful surveillance, discrimination, harassment, deception, fraud, or harmful automated decision-making;
- upload or distribute malware, disrupt the Service, or test its security without written authorization;
- violate privacy, publicity, intellectual-property, consumer-protection, export-control, or other applicable rights or laws;
- resell, sublicense, mirror, or expose the Service itself beyond the rights granted by your Plan or order form; or
- claim that SoldFetch or your use of the Service is affiliated with, sponsored by, or endorsed by eBay.
We may investigate suspected violations and take proportionate action, including limiting Operations, revoking API Keys, suspending access, preserving relevant records, or terminating an account. We will provide notice and an opportunity to respond when practical, except where immediate action is reasonably necessary to protect the Service, a provider, a customer, or another person.
8. Third-Party Marketplace Data
8.1 Nature of Marketplace Data
The Service retrieves publicly observable eBay marketplace information through Upstream Providers. Marketplace Data may change quickly and may be incomplete, delayed, duplicated, localized, or unavailable. Price, availability, delivery, rankings, reviews, and seller information can vary by marketplace, location, account state, and observation time.
8.2 Estimates and Accuracy
Sales, stock, engagement, and similar derived values are estimates, not reported transactions, guaranteed inventory, or verified facts. You must review Output and its freshness metadata before relying on it. We do not warrant that Marketplace Data or estimates are complete, current, accurate, or fit for a particular decision.
8.3 Your Responsibilities
You are responsible for determining whether your acquisition, storage, combination, analysis, display, and distribution of Output complies with applicable law, marketplace terms, intellectual-property rights, privacy obligations, and contractual restrictions. SoldFetch does not provide legal permission to use third-party material.
8.4 Third-Party Services
SoldFetch relies on hosting, authentication, payment, storage, email, analytics, network, and Upstream Providers. We are not responsible for third-party outages, changes, restrictions, or discontinuations outside our reasonable control, but we will use commercially reasonable efforts to maintain the Service and manage provider dependencies.
8.5 Independence
eBay and related marks are trademarks of their respective owners. SoldFetch is independently developed and is not endorsed by, sponsored by, or affiliated with eBay or an Upstream Provider.
9. Intellectual Property
9.1 SoldFetch Materials
SoldFetch and its licensors retain all rights in the Service, software, Documentation, response schemas, site content, designs, branding, and underlying technology. Except for the limited access right granted below, these Terms do not transfer any intellectual-property right to you.
9.2 Limited Right to Use the Service
Subject to these Terms and payment of applicable fees, SoldFetch grants you a limited, non-exclusive, non-transferable, revocable right to access and use the Service for your business or professional purposes during the applicable Plan term. You may allow authorized organization members and applications to use the Service on your behalf.
On a paid Plan, including Starter, you may use Output to calculate and provide transformed analyses, dashboards, rankings, concentration measures, and reports to multiple customers, including as part of a paid product or service. This permission applies only when your product adds material analysis or presentation and does not expose API Keys, provide raw API access, operate as a substitute or passthrough for the Service, redistribute Output in bulk, or enable a recipient to reconstruct a material portion of the underlying response collection.
You may cache underlying responses for up to 12 months from retrieval for reproducibility, audit, customer support, and historical evidence. Preserve the marketplace, resolved product identity, returned retrieval and estimation times, model version, and estimate label with retained sales estimates. A signed order form may authorize a different retention period. When your right to use the Service ends, you may retain archival evidence required by law or reasonably needed to support reports already delivered, but you may not use retained raw Output to create new products or reports.
SoldFetch attribution is not required unless an order form says otherwise. You must continue to comply with applicable third-party attribution, trademark, marketplace, and other rights. You must label sales estimates as estimates and must not present them as seller-reported transactions or verified revenue.
9.3 Your Materials and Third-Party Content
You retain rights in original information, applications, and materials you submit or create. You grant SoldFetch a limited license to host, transmit, transform, and otherwise process submitted information only as needed to provide, secure, support, and improve the Service, enforce these Terms, and meet legal obligations.
SoldFetch does not grant you ownership of Marketplace Data, eBay marks, or third-party content. Rights in those materials remain with their respective owners.
9.4 Feedback
If you voluntarily provide suggestions or feedback, you grant SoldFetch a perpetual, worldwide, royalty-free right to use it without restriction or obligation, provided we do not identify you publicly as the source without permission.
10. Privacy and Data Protection
Our Privacy Policy explains how SoldFetch collects, uses, shares, stores, and protects personal information. It forms part of these Terms.
You are responsible for the lawfulness of personal information or identifiers you submit through the Service and for providing required notices and obtaining required permissions. If SoldFetch processes personal information on your behalf under a separate data processing agreement, that agreement controls for the processing it covers.
11. Service Availability and Disclaimers
11.1 Availability and Changes
We aim to provide a reliable Service but do not promise uninterrupted or error-free operation. Maintenance, security events, provider failures, network conditions, marketplace changes, and circumstances outside our reasonable control may affect availability or Output.
We may improve, replace, or retire features, endpoints, schemas, or limits. We will use reasonable efforts to document material changes and, where practical, provide advance notice or a migration path for a breaking change.
11.2 No Service-Level Agreement Unless Agreed
No uptime, response-time, support-time, or service-credit commitment applies unless it is expressly included in a signed enterprise order form or service-level agreement.
11.3 Disclaimer
To the extent permitted by law, the Service and Output are provided "as is" and "as available." SoldFetch disclaims implied warranties of merchantability, fitness for a particular purpose, non-infringement, accuracy, and uninterrupted operation. This disclaimer does not exclude promises expressly stated in these Terms or rights and warranties that cannot lawfully be excluded.
12. Limitation of Liability
12.1 Excluded Losses
To the extent permitted by law, neither party is liable to the other for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, revenue, goodwill, business opportunities, or anticipated savings arising from the Service, even if advised that such loss was possible.
12.2 Liability Cap
To the extent permitted by law, SoldFetch's total aggregate liability arising out of or relating to the Service and these Terms will not exceed the greater of USD 100 or the fees you paid to SoldFetch for the Service during the 12 months immediately before the event giving rise to the claim.
12.3 Liability That Is Not Limited
Nothing in these Terms excludes or limits liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation, deliberate misconduct, payment obligations already incurred, or any other liability that cannot lawfully be excluded or limited. If you are a consumer, nothing in these Terms limits mandatory statutory rights or remedies available to you.
13. Indemnification
If you use the Service on behalf of a business or organization, you will defend and indemnify SoldFetch and its personnel against third-party claims, damages, and reasonable costs arising from your unlawful use of the Service, your material breach of these Terms (including Section 7), or materials you submit or distribute through the Service.
This obligation does not apply to the extent a claim results from SoldFetch's breach, negligence, or willful misconduct. We will notify you reasonably promptly of a covered claim and allow you to control its defense, provided you may not settle a claim in a way that admits fault by or imposes an obligation on SoldFetch without our written consent. This section does not apply to consumers where prohibited by law.
14. Suspension and Termination
14.1 Termination by You
You may stop using the Service at any time. Organization owners and authorized billing administrators may cancel an eligible paid Plan through the billing portal. Cancellation generally takes effect at the end of the current billing period, and accrued usage charges remain payable.
14.2 Suspension or Termination by SoldFetch
We may limit, suspend, or terminate access if we reasonably determine that:
- you materially breached these Terms, including the acceptable-use requirements in Section 7;
- payment is overdue or repeatedly fails;
- activity threatens the security, integrity, availability, or lawful operation of the Service;
- continued access creates material risk to a provider, customer, or third party; or
- action is required by law, a court, a regulator, or a provider restriction.
Except in an emergency or where prohibited by law, we will use reasonable efforts to give notice and, for a remediable breach, an opportunity to cure before termination.
14.3 Effect of Termination
When access ends, your right to use the Service and API Keys ends. You remain responsible for charges incurred before termination. Account data is handled according to the Privacy Policy and applicable retention obligations.
14.4 Survival
Payment obligations, ownership provisions, disclaimers, liability limitations, indemnification, dispute provisions, and any terms that by their nature should survive will continue after termination.
15. Changes to These Terms
We may update these Terms prospectively to reflect changes in the Service, commercial model, providers, law, or risk. We will update the "Last Updated" date and, where a change materially reduces your rights or increases your obligations, provide reasonable advance notice by email, dashboard notice, or another prominent method where required or practical.
Material changes will take effect on the date stated in the notice. If you do not agree, you may stop using the Service and cancel a paid Plan before the new terms take effect. Continued use after the effective date constitutes acceptance where permitted by law. Changes to fees or a signed enterprise agreement apply as stated at checkout, in the relevant notice, or in that agreement.
16. Governing Law and Disputes
16.1 Informal Resolution
Before filing a formal claim, each party will make a reasonable attempt to resolve the dispute by written notice and good-faith discussion. Send a notice describing the dispute and requested resolution to contact@soldfetch.com. This does not prevent either party from seeking urgent injunctive or equitable relief.
16.2 Applicable Law and Courts
These Terms are governed by the laws applicable in the jurisdiction where SoldFetch is established, without regard to conflict-of-laws rules. Courts with jurisdiction over SoldFetch will have non-exclusive jurisdiction over disputes, except where the parties agree otherwise in an order form.
If you are a consumer, this section does not deprive you of mandatory protections or any right to bring a claim in a competent court available under the law of your country of residence.
17. General Provisions
17.1 Entire Agreement and Priority
These Terms, the Privacy Policy, the Cookie Policy, and any applicable order form constitute the agreement for the Service. An order form or data processing agreement controls over these Terms only for a direct conflict concerning its subject matter.
17.2 Assignment
You may not assign these Terms without SoldFetch's prior written consent, except as part of a genuine merger, reorganization, or sale of substantially all relevant assets and after written notice. SoldFetch may assign these Terms as part of a merger, reorganization, financing, or sale of its business, or to an affiliate, provided the assignment does not reduce mandatory rights.
17.3 Severability and Waiver
If a provision is held unenforceable, it will be modified to the minimum extent necessary or severed, and the remaining provisions will continue. Failure to enforce a provision is not a waiver. A waiver must be in writing and applies only to the specific circumstance stated.
17.4 Force Majeure
Neither party is liable for delay or failure caused by events beyond its reasonable control, including natural disasters, war, civil unrest, government action, labor disputes, widespread network failure, or third-party infrastructure failure. This does not excuse payment obligations already incurred.
17.5 No Third-Party Beneficiaries
Unless these Terms expressly say otherwise, they do not create enforceable rights for anyone who is not a party to them.
17.6 Notices
We may send operational or legal notices to the email address associated with your account or display them in the Service. You are responsible for keeping your account email current. Notices to SoldFetch must be sent to contact@soldfetch.com.
